Grand Prize Ultimate Fan Package
Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.
1. How to Enter the Contest:
a. The FAN FRENZY contest will begin on (or before) Friday, February 8, 2008 @ approximately 6:00am Eastern Time (“ET”) and will end on, or before, Friday, November 23, 2008 @ approximately 10:00am ET. To enter the contest, entrants must go to www.witl.com, click on the link for this contest and register by completing and submitting the registration form, providing their name, address, email address, date of birth and the creation of a unique username and password. Once registered, participants must make their picks prior to each eligible NASCAR Sprint Cup Race of the 2008 season (a schedule of which appears on the website and which will be announced on air throughout the contest period), in accordance with the rules attached hereto and made a part hereof. There will be a total of thirty-seven (37) eligible races. There is no deadline to enter (entrants may register to participate at any time during the contest season), but to be eligible for an individual week’s race, a participant must be registered and their picks must be submitted at least one (1) hour prior to the schedule start time of the designated race for that that week.
b. See Addendum to Fan Frenzy contest rules, supplied by UPICKEM, at the end of these rules, for more details. The addendum is incorporated herein and made a part hereof by reference. This is a website contest and participants must have access to a computer with internet access to participate in or win this game. WITL is not responsible for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technological glitches. Entrants may be disqualified in the sole discretion of Station.
c. Participants may only register a maximum of one (1) eligible account in this contest.
2. Eligibility Restrictions:
a. The contest is open to all WITL listeners who are legal United States citizens 18 years of age or older and who reside in the Mid-Michigan listening area. Employees of WITL, its licensee, Citadel Broadcasting Company, their affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners, other radio stations in the Mid-Michigan area and the members of their immediate families are ineligible to participate or win. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household.
b. Listeners are eligible to win a WITL contest only once every thirty (30) days. Only one (1) winner per household is permitted in any contest. Winners must possess a valid government issued photo identification and must meet all eligibility requirements set forth herein and the Fan Frenzy addendum, incorporated herein by reference.
c. To enter on-line you must enter your first name and last name, complete address, city, state, zip code, home telephone number and a valid e-mail address in the on-line entry form. One Internet entry per person and one Internet entry per e-mail address. Internet entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an internet access provider, on-line service provider, or other organization that is responsible by assigning e-mail addresses or the domain associated with the submitted e-mail address.
3. Prizes:
a. The one (1) final grand prize winner of Fan Frenzy, as determined by the website contest rules described in the Addendum to Fan Frenzy Rules provided by UPICKEM at the end of these rules, will receive one (1) gift certificate from Brooklyn Ford in Brooklyn, MI redeemable for a 2-year lease on a new (the newer of 2008 or 2009, based on when it the vehicle is actually awarded) Ford F-150 truck, valued at approximately $6,000.00 for the 2-year lease. This will be awarded to the eligible winner in the form of a gift certificate redeemable at Brooklyn Ford, located at 10405 N. Brooklyn Rd. in Brooklyn, MI 49230. This prize is provided courtesy of Brooklyn Ford. The winner must qualify for credit for the 2-year lease through Brooklyn Ford, subject to Brooklyn Ford’s standard credit rules, in order to be eligible to redeem this prize. In the event that the winner is unable to qualify for credit, or otherwise chooses to accept the alternate prize, the winner will be awarded an alternate prize of $3,000.00 issued in the form of a check from Brooklyn Ford made out to the winner. This figure is ½ the approximate 2-year lease value of a new Ford F-150 according to Brooklyn Ford. The winner will be solely responsible for tax, title, license and proof of insurance before being deemed eligible to receive the prize offered. The lease includes a mileage allowance of 21,000 miles for the duration of the lease; any mileage above this allowance will be the sole financial responsibility of the winner. There will be a total of one (1) Grand Prize awarded to one (1) Grand Prize Winner – A 2-year lease from Brooklyn Ford on a Ford F-150 Truck (ARV: $6,000.00) or $3,000.00 cash from Brooklyn Ford. The cash prize of $3,000.00 will be offered if the Grand Prize Winner does not qualify for appropriate credit for the 2-year lease or otherwise exercises their option to accept this $3,000 alternate prize instead of the vehicle. Grand Prize Winner will be solely responsible for any applicable vehicle title, license and registration fees, freight, delivery, dealer prep, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, and any and all other fees and expenses not specified herein associated with the receipt and use of this prize vehicle. Any additional car options (including the interior and exterior color of the prize) not specified herein are subject to availability and will be the sole responsibility, and at the sole expense, of the Winner. Prize Winner must provide proof of insurance, meeting minimum automobile insurance requirements as set forth by the State of Michigan, and a valid state-issued driver's license, in order to take delivery of prize. If the Grand Prize winner can not pass the credit check, then the winner must take the $3,000.00. Grand Prize Winners will be solely responsible for all gratuities, taxes and any other incidental expenses that are not included herein. Winner must pass all qualifying standards set by Brooklyn Ford (or designated agency/company issuing credit) and must comply with all terms and conditions that are standard for a comparable lease to be deemed eligible to receive the lease which includes but not limited to: Must be 18 years of age, credit worthy by set standards, and have a valid state-issued Drivers License. If the Grand Prize winner cannot pass the credit check, then the winner must take the $3,000.00. The Grand Prize winner will be required to sign the dealership’s standard lease agreement and standard terms and conditions.
b. There will also be a total of thirty-seven (37) Weekly winners, one (1) selected at the end of each eligible week during the contest period, who will receive a prize package valued at not more than $100.00. The prize packages will consist of a random selection of CD’s, MIS promotional items, and small prizes (approximately $10.00-$15.00 value maximum per prize from various non-competing sponsors) and/or prizes provided by WITL. Weekly winners will be notified of their winning and prize description via email at the address used for entering the contest. Weekly winners will be required to show valid photo ID, Social Security Card and sign a prize claim form which will include the entire value of the prize package.
c. Decisions of station management with respect to the contest are final.
d. Sponsor may, solely at its discretion, substitute prizes of comparable value. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses that may arise out of one’s receipt and use of a prize. Other restrictions may apply.
e. Winners will be required to sign a Contest Winner Release prior to receipt of their prize.
f. Winner agrees to accept any and all prizes “as is” with no written or express warranty.
4. Selection of Winners:
a. Decisions of station management with respect to the contest are final.
b. All prizes or prize certificates may be picked up at the office of WITL, 3420 Pine Tree Road, Lansing, MI 48911. Any prize or prize certificate not claimed within 14 days of winning (2 weeks from notification) will be forfeited by the winner. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. WITL is not responsible for the safe arrival of a prize or prize certificate
c. Contest prizes are not transferable. Weekly Prizes may not be substituted for or redeemed for cash. The Grand Prize may be substituted for cash in the event that the winner does not qualify for credit for the 2-year lease. (see Rule 3-a).
d. The winner will be required to adhere to the prize claim dates outlined on the gift certificate through Brooklyn Ford as well as any other restrictions or eligibility requirements set forth herein. If any winner fails to redeem certificate(s) within the specified time period, the certificate becomes void and no further restitution will be made by WITL, Citadel Broadcasting, UPICKEM, Fan Frenzy or any associated sponsor or agency affiliated with this contest.
e. The odds of winning depend upon the number of eligible participants.
4. Selection of Winners:
a. Decisions of station management with respect to the contest are final.
b. The grand prize winner will be determined at the end of the Fan Frenzy contest, which will conclude after the final race of the 2008 NASCAR Racing Season, on or before Friday, November 23, 2008. Weekly winners will be determined by point standings through the Fan Frenzy contest website: the eligible participant who receives the highest number of points in any eligible week during the contest period will be the weekly winner for that week. Names will be provided weekly to WITL to announce on-air. These winners will be notified via email from Fan Frenzy that they are a winner and will also be contacted by WITL with instructions on claiming prizes. The weekly winners will receive the prize packages described above. This final date will depend upon the final race of the NASCAR racing season, which will is yet to be determined and based on postponements and race cancellations or re-runnings.
c. One (1) Grand Prize winner will be determined at the conclusion of Racing Season. This final winner will receive the prize package described above courtesy of Brooklyn Ford in the form of a gift certificate. The winner will be notified by email from Fan Frenzy and also contacted by WITL with instruction on claiming the prize.
5. Conditions:
a. Photo identification and social security number of the Grand Prize winner may also be required in order to collect the prize. Payment of all federal, state and local taxes are the sole responsibility of the winner. Winners will be required to sign an IRS Form W-9 or the equivalent. Winner will receive a 1099 for the value of the prize as stated in these contest rules.
b. Winner is required to sign a release in order receive their prize. Failure or refusal to execute the release will result in winner forfeiting the prize. Pursuant to the liability release, the winners will agree to hold WITL, its licensee, Citadel Broadcasting Corporation, their subsidiaries, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
c. By participating in the contest, the winner or winners (and their guest or traveling companion, if applicable) agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize.
d. WITL, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WITL Web Site or who is otherwise in violation of the rules. The station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
6. WITL reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason. Material modifications shall be announced on-air, when practical. By participating in this contest, you agree to be bound by these contest rules, any modifications thereof, and by all other rules imposed by Station management. If due to circumstances beyond the control of Station, any event associated with this contest or the prize is delayed, rescheduled, postponed or cancelled, Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
7. No purchase is necessary. The contest is void where prohibited.
8. Failure to comply with the contest rules may result in a contestant's disqualification, at the sole discretion of WITL.
9. WITL is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.
10. Station reserves the right to substitute a prize of greater or equal value at its sole discretion.
11. Copies of the written contest rules and a list of all winners are available during regular business hours at the main studio of Citadel Broadcasting/Lansing, 3420 Pine Tree Road, Lansing, MI 48911 or by sending a self-addressed stamped envelope to WITL/FAN FRENZY CONTEST, 3420 Pine Tree Road, Lansing, MI 48911.
INTERNET SWEEPSTAKES PRIVACY POLICY
a. By use of this website and by entering the contest, you agree to the WITL Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at http://www.witl.com/privacy.shtml.
No purchase necessary. One valid entry per contestant.
You must be 18 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
UPICKEM and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.
Affiliates reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to UPICKEM and its affiliates the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
UPICKEM and its affiliates reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and its affiliates are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
If a race is canceled, forfeited, or indefinitely suspended for any reason that race shall not count for any contestant and scores will be computed as if the race did not exist.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
For each race, players will pick the 10 drivers they think will finish 1st through 10th. Drivers will be awarded Fantasy Points depending on how they finish. 1st place is worth 150, 2nd place is worth 125, 3rd place is worth 100, 4th place is worth 80, 5th place is worth 78, and so on (less 2 points each place). 44th place and beyond are worth 0 points. The total Fantasy Points for all the player's drivers in the race becomes the Team Score. There is an additional 25 point bonus for every driver that comes in the exact order the player picks them to finish.
You total score is the sum of your best 15 races.
If there is a tie for the most points for a race, the tie breaker is handled by first seeing who picked the most drivers in the right order. If there is still a tie, the computer will see who picked the highest place correct. If there is still a tie, the computer will randomly select a winner from the players that are tied.
If there are ties for overall score, the computer will select the player with the most race points for the most recent race. If there is a tie, the computer will continue comparing race points for previous races until a winner is selected. If the players are tied for all the races, the computer wil randomly select a winner from the players that are tied.
Points are awarded to drivers, not cars. If a player picks a driver who qualified for race and a new driver took his/her place before the start of the race, the player must pick the new driver. Players will not receive points even though the new driver may be racing the previous driver's car. And, if the new driver is not in the list of drivers that can be picked then no players shall have the ability to pick that driver and it will not count for or against anyone.
Weekly winners are based on the race finish order immediately following the race. If the race finish order is adjusted after the race, the weekly winners will remain the same but all players' points will be recomputed for the season total.
All decisions of the judges are final.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
